Warranty & Terms of Sale

Please Note: All goods carry a 24 month guarantee; your receipt is your guarantee. See below for details. All returns/cancelled orders are subject to a 25% restocking charge (of the order total). Delivery is “to your door”, goods brought upstairs is at the customers risk. Damaged items or shortages in orders must be reported within 24 hours.

2 Year Limited Warranty

  1. The mattress/base purchased has a limited warranty of 2 years from the date of purchase.

  2. The mattress/base may be replaced after inspection, if it is found to have been manufactured with faulty materials. Any faults have to be objectively measured and observed

  3. This limited warranty does not cover normal wear and tear, cuts or scratches, or damage caused by impacts or accidents.

  4. The mattress will not be replaced due to a loss of comfort or support that occurs through normal wear and tear. Faults that cannot be objectively measurable or cannot be clearly observable, such as excessive softening or loss of support are not covered under this warranty.

  5. A mattress may be liable for replacement if sagging depth is clearly observable at a depth more than 2.5 inches.

  6. This limited warranty does not apply to products that have been stored or installed incorrectly, used inappropriately, abused, misused, altered, or cleaned with wrong cleaning products/methods or incidental damage.

  7. This warranty does not apply if the product has been placed outdoors or in a humid environment.

  8. This limited warranty does not cover consequential or incidental damage.

  9. The purchase receipt is required as proof of purchase.

  10. This limited warranty applies to domestic use only.

  11. The warranty may be deemed void if:

    1. There is an improper foundation/frame that does not give a reasonable foundation to your mattress. A reasonable foundation is one that spans the width and length of the mattress keeping the mattress in a stable state. An improper foundation can result in premature wear and sagging of the mattress.

    2. The mattress has been subject to staining, soiling or fluid penetration. Even if the staining, soiling or fluid penetration is not near a defective area, such as where sagging is located, the warranty will not cover the replacement of the mattress. It is wise to use a protector/pad from the first day of use.

 

 

 

Terms of Sale
 

If you are contracting as a consumer, you may cancel a contract at any time within 7 working days, beginning on the day after you received the products. Provided you comply reasonable care of the products, you will receive a full refund of the price paid for the products in accordance with our returns policy.To cancel a contract, you must inform us by sending an email to info@empirebeds.ie.

 

If the products have been processed for delivery or have been delivered at the time you notify us of your wish to cancel the contract, then the products must be returned to us at your own cost and risk. We will arrange for the products to be collected from you either by us or by a third party and will make a charge for providing this service.You have a legal obligation to take reasonable care of the products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation. Taking reasonable care in relation to mattresses includes, for example, not removing the protective packaging encasing the mattress.

 


Returns Policy

Important: All returns/cancelled orders are subject to a 25% restocking charge (of the order total).

Beds and Mattresses can only be returned if they are unopened. Purchased items which have been opened or slept on, cannot be returned for hygiene reasons. If you wish to test a product(s) that you are unsure of, please keep it sealed in its original packaging and inform our driver/staff, that you want the product to remain sealed until you have tested it. A mattress can be tested for comfort whilst it is still inside the packaging and therefore for hygiene reasons once the packaging has been opened the product will then be classed as used and cannot be returned. 


If you have cancelled the contract in accordance with "Terms of Sale" above and the products have been processed for delivery or have been delivered to you then we will arrange for the products to be collected from you. Following the collection of the products from you, we will check that you have taken reasonable care of the products. Subject to our being satisfied that you have taken reasonable care of the products, we will process the refund to you as soon as possible, and, in any case, within 30 days following the day on which you have given notice of your cancellation of the contract. In these circumstances, we will refund the price of products in full. However, we will deduct a collection charge of €50 from the amount due to you.

If you have cancelled the contract in accordance with the above, we will process the refund due to you as soon as possible and, in any case, within 30 days follows the day on which you gave us notice of cancellation of the contract. If you cancel the contract for any other reason (for example, if you think the Products are defective or they do not match their description), we will collect the products from you and examine the returned products. We will notify you of our decision regarding a refund within a reasonable period of time. We will usually process any refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you via e-mail that you were entitled to a refund. Products returned to us because of a defect will be refunded in full, excluding a charge we may have levied for the collection of the products. 

We will refund you using the same method you used to pay for the products.

Unfortunately, we cannot stop an order once it's been confirmed by us. If you change your mind about your order after this point you can return the products to us in accordance with this returns policy.

This returns policy does not affect your statutory rights in respect of defective products.
